Licences, registration and fire NOC for a self-study library
Which licences a study library needs: fire NOC and safety, building use and basements, shops and establishments rules by state, trade licence, GST and Udyam. Updated after the 2026 sealing drives.
This guide is general information, not legal advice. Rules differ by state and city and change often. Before you open, confirm with your local municipal body, fire office and labour department, and keep their replies in writing.
The short answer
There is no single “library licence”. What a self-study library needs comes from five places:
- Fire safety: the building must meet fire norms, and many buildings need a fire NOC.
- Building use: the premises must be allowed for commercial or educational use. Residential flats and storage basements usually are not.
- Shop and Establishment registration under your state’s law, which now exempts small units in several states.
- A municipal trade licence, if your city requires one.
- GST, once your turnover crosses the limit.
Since a coaching building fire in Lucknow on 22 June 2026, district officials in Uttar Pradesh, Rajasthan and Madhya Pradesh have sealed libraries that lacked a fire NOC or were running in buildings not approved for that use. Fire safety is now the first thing to sort out.
Fire safety and fire NOC
Why it matters now
- In July 2024, three students died when the basement of a coaching centre in Old Rajinder Nagar, Delhi flooded. The basement was approved for storage but was being run as a library. Delhi’s municipal corporation sealed 13 coaching centre basements in the days that followed, and in Indore 13 coaching institutes and libraries in basements were sealed for missing fire equipment, a single exit and plywood partitions.
- After the Lucknow fire in June 2026, Mathura, Kannauj, Fatehpur, Hamirpur and other UP districts sealed libraries. Etah asked every coaching centre and library to submit a copy of its fire NOC before operating. In Jaipur, the municipal corporation had issued more than 2,000 fire NOC notices by July 2026 and sealed a library in Vidyadhar Nagar.
What decides whether you need a fire NOC
The rules are state laws, so the thresholds differ. They usually depend on the building’s height or number of floors, how it is used, how many people are inside, and whether there is a basement. Two examples:
- Delhi: under Rule 27 of the Delhi Fire Service Rules 2010, a fire NOC is needed for educational buildings taller than 9 metres or with ground plus two upper floors, business buildings taller than 15 metres or with ground plus four upper floors, all assembly buildings, and all underground structures.
- Rajasthan: the state’s 2026 fire safety provisions require a fire NOC before final building plan approval in Jaipur, and buildings that need a NOC must have at least two staircases.
Which category is a study library? The National Building Code 2016 lists libraries as business buildings (group E-2). But the Delhi High Court has said a building’s character depends on how it is used, and premises with more than 20 students must meet the norms for educational buildings. Officials may treat a busy study hall as educational, which has stricter thresholds. Plan for the stricter one.
What inspectors look for
- At least two separate exits, and staircases kept clear.
- Fire extinguishers of the right type, filled and in date, where people can reach them.
- Emergency lighting and exit signs.
- Safe wiring and no overloaded sockets; no plywood or foam partitions between cabins.
- No study hall in a basement that is not approved for it.
Apply to your city’s fire department (most states take applications online), fix what the inspection finds, and keep the NOC on display. In Patna, for example, the district fire officer can issue a NOC in 7 to 10 days once deficiencies are fixed.
Building use and basements
Many of the 2026 sealings were for illegal commercial use: libraries and coaching centres in buildings sanctioned as residential. The building in the Lucknow fire had been sanctioned as residential and later used commercially. Before you sign a lease, ask the owner for the sanctioned map and the permitted use, and check it with the development authority or municipal body.
Basements are the biggest risk. A basement approved for parking or storage cannot be used as a study hall, and a basement in use needs at least two independent exits under the National Building Code.
Shop and Establishment registration
Each state has its own shops and establishments law, and several have recently stopped requiring registration from small units:

Most single-branch libraries have one to five staff, so in Rajasthan, Uttar Pradesh and Bihar they may not need to register at all. Where registration is free and quick, it can still be useful as proof of business, for example when opening a current account.
Municipal trade licence
Some cities require a trade licence for commercial premises. In Uttar Pradesh it is issued by the urban local body through the Nivesh Mitra portal, with the fee calculated automatically and a 30-day service deadline. We found no city with a separate licence category for libraries, so ask your municipal office which category applies.
GST
- Registration is needed once your yearly turnover crosses ₹20 lakh(₹10 lakh in Manipur, Mizoram, Nagaland and Tripura). An 80-seat library collecting ₹1,100 a seat from 64 members takes about ₹8.4 lakh a year, well under the limit.
- Library services fall under SAC 998451 and are taxed at 18% once registered. The only exemption is for public libraries lending books, which a paid study seat is not.
- We found no advance ruling or CBIC clarification specific to study-seat fees. If you are near the limit, or run several branches under one PAN, talk to a chartered accountant.
Udyam (MSME) registration
Udyam registration is free, online, based on your Aadhaar and a self-declaration, and never needs renewing. It is optional; it puts your library on record as a micro enterprise.
Do coaching laws apply?
Coaching laws cover teaching, not quiet study. The Centre’s 2024 guidelines define a coaching centre as tuition for more than 50 students, and Rajasthan’s 2025 coaching law applies above 100 students; neither mentions libraries. But some districts have used coaching rules against libraries anyway: in July 2026 Jhansi’s district magistrate ordered coaching centres and libraries without a fire NOC and registration to be sealed. If you also run classes, coaching rules apply to that part of the business.
Checklist before you open
- Sanctioned map shows commercial or educational use for your floor.
- Not in a basement, or a basement approved for this use with two exits.
- Fire NOC, or a written reply from the fire office that you do not need one.
- Extinguishers, emergency lights, exit signs, clear stairs, safe wiring.
- Shop and Establishment registration, if your state requires it at your staff size.
- Trade licence, if your city requires one.
- A current account and UPI merchant ID in the library’s name.
- GST registration once turnover nears ₹20 lakh.

Rules and fees change and differ by state and city. Check with the office concerned before you act.
Questions
Is there a special licence for a self-study library?
No state we checked has a licence made only for self-study libraries. What you need depends on your building (fire safety and permitted use), your state’s shops law and staff count, your city’s trade licence rules, and your turnover (GST).
Do I need a fire NOC for a small library?
It depends on the building’s height, floors, use and whether it has a basement, and the rules differ by state. Many cities started checking libraries in 2026, so ask your local fire office in writing before you open, and keep the reply.
Can I run a library in a basement?
Only if the basement is approved for that use and has safe exits. Basements approved for storage or parking cannot be used as study halls; basement libraries were sealed in Delhi in 2024 and in several cities in 2026.
Do I need GST registration?
Only once your yearly turnover crosses ₹20 lakh (₹10 lakh in Manipur, Mizoram, Nagaland and Tripura), unless you register voluntarily. That is about ₹1.67 lakh of fees a month. Ask a chartered accountant about your case.
